Terms of Service

Effective July 7, 2026

These Terms of Service govern your access to and use of Cthru, including the Cthru mobile app, website, music discovery features, generated stations and playlists, Sonic ID, Tastemaker features, Tune In live profile sessions, account features, and related services.

These Terms are between you and Julio Gonzalez, doing business as Cthru ("Cthru," "we," "us," or "our"). They are not between you and Apple. If you do not agree to these Terms, do not use Cthru.

Who may use Cthru

You must be at least 13 years old to use Cthru. If you are under the age of majority where you live, you may use Cthru only with permission from a parent or legal guardian who agrees to these Terms.

You may use Cthru only if you can form a binding agreement with us and only in compliance with these Terms and all applicable laws.

What Cthru does

Cthru is a music discovery app. It can help you connect Apple Music, build a Sonic ID or taste profile, generate stations and playlists, play music through supported providers, save Cthru-created favorites, discover Tastemaker profiles, share Cthru-created music surfaces, and tune into host-authorized live listening sessions through your own supported music account.

Cthru is not Apple Music and does not sell Apple Music access.

Apple Music and third-party services

Cthru integrates with Apple Music and may use Apple's MusicKit and Apple Music APIs. When you connect Apple Music, Apple may ask you to authorize Cthru to access your Apple Music account or music data. Cthru uses this access to provide playback, music metadata, Sonic ID, generated stations, playlists, recommendations, Tastemaker experiences, and Tune In live profile sessions.

Apple Music access, Apple Music subscriptions, catalog availability, playback, artwork, metadata, storefront availability, and Apple Music account features are controlled by Apple and may change, fail, or become unavailable. Full-track playback may require an active Apple Music subscription and may not be available in all regions.

You must comply with Apple Media Services Terms and any other third-party terms that apply to your use of Apple Music, MusicKit, or other connected services.

Cthru does not download, upload, rehost, sell, or let users share music files sourced from MusicKit or Apple Music except where explicitly allowed by Apple. Cthru may display and process music metadata, artwork, identifiers, and generated Cthru read models as needed to provide the service and as described in our Privacy Policy.

Accounts and sign-in

Some Cthru features require an account. You are responsible for the activity on your account and for keeping your sign-in credentials secure. If you believe your account has been compromised, contact support@cthru.app.

You agree to provide accurate account information and not impersonate anyone else. We may suspend or terminate accounts that violate these Terms, create risk for Cthru or other users, infringe rights, abuse the service, or violate law.

Cthru provides a way to initiate account deletion in the app. Deleting your account will delete the account record and associated personal data as described in our Privacy Policy, except where retention is legally, security, billing, anti-abuse, or operationally required.

Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using account-based, Apple Music-powered, cloud, sharing, Tune In, or paid features, you acknowledge that Cthru will process information as described in the Privacy Policy.

Your content

"Your Content" means content you submit, upload, save, create, edit, or share through Cthru, such as profile information, avatars, usernames, display names, station names, playlist names, reports, reactions where available, and other user-provided material.

You keep ownership of Your Content. You grant Cthru a worldwide, non-exclusive, royalty-free license to host, store, copy, process, modify for technical purposes, display, publish, distribute, and use Your Content solely as needed to operate, improve, protect, and provide the service, including sharing Your Content according to your visibility settings.

You represent that you have all rights needed to provide Your Content and grant this license. You may not submit content that is illegal, infringing, harassing, abusive, hateful, sexually explicit, threatening, deceptive, invasive of privacy, or otherwise harmful.

Cthru may remove, hide, restrict, moderate, or refuse to display Your Content, and may suspend or terminate accounts, if we believe Your Content or conduct violates these Terms, law, third-party rights, platform rules, or user safety expectations.

Tastemakers, sharing, and visibility

Cthru may let users discover, request access to, follow, share, or view Tastemaker profiles, Cthru-created stations, Cthru-created playlists, Cthru-created favorite-track snapshots or read models, Tune In live profile sessions, listened-through-profile activity, and other music discovery surfaces.

Your visibility settings control how supported Cthru surfaces are shared. Shared Cthru surfaces may include Cthru-created metadata or read models, but Cthru does not share raw Apple Music library contents, raw Apple Music playlists, raw Apple Music favorites, Apple Music audio files, or private listening activity outside explicit Cthru sharing, Tune In, or listened-through-profile surfaces.

Other users may change or remove their profiles, shared content, permissions, or connections. Cthru does not guarantee that any Tastemaker, profile, station, playlist, recommendation, or shared surface will remain available.

Tune In live listening

Tune In is a live listening feature. If you choose to allow Tune In for a listening session, eligible profile viewers may see that you are live and may be able to view allowed current-track metadata, tune in through their own Apple Music account, react, and appear in live-session or recent activity surfaces.

Tune In is not account sharing, audio streaming, a public broadcast, a shared queue, or a promise of exact synchronized playback. Cthru does not stream, record, rebroadcast, or relay Apple Music audio from one user to another. Cthru may sync compact session metadata, such as a current Apple catalog ID, approximate playback position, play/pause state, timestamp, listener participation, and reactions, so eligible listeners can attempt local playback through their own Apple Music authorization.

Hosts may turn Tune In off, go private, hide current-track metadata where supported, remove listeners, block users, or end a session. Listeners may leave or take local playback control. Cthru may retain Tune In participation, reaction, removal, block, session-ending, and listened-through-profile records as described in the Privacy Policy and as needed to operate, protect, and improve the service.

Acceptable use

You agree not to:

  • violate law or third-party rights;
  • harass, threaten, abuse, stalk, defame, impersonate, or harm others;
  • upload or share infringing, illegal, deceptive, hateful, sexually explicit, violent, or otherwise objectionable content;
  • scrape, crawl, harvest, or mass collect data from Cthru without permission;
  • reverse engineer, decompile, tamper with, or bypass the service except as allowed by law;
  • interfere with security, rate limits, provider restrictions, access controls, or moderation systems;
  • use Cthru to spam, phish, defraud, manipulate, or mislead;
  • attempt to download, upload, rehost, redistribute, sell, or share Apple Music audio files or other protected third-party content through Cthru;
  • misuse Tune In or live profile features to surveil, harass, shame, or expose another user's listening activity outside the controls Cthru provides;
  • represent Tune In as a broadcast, account-sharing, or audio-streaming service;
  • use Cthru or Apple Music data for advertising, tracking, device fingerprinting, or unrelated third-party sharing; or
  • use Cthru in a way that could damage Cthru, users, Apple, music rights-holders, or other third parties.

Feedback and reviews

If you send Cthru ideas, suggestions, bug reports, or other feedback, you allow us to use that feedback without restriction or compensation. Nothing in these Terms limits your right to leave honest reviews or share truthful opinions about Cthru, as protected by applicable law.

Cthru intellectual property

Cthru and its licensors own the service, including the app, website, software, design, trade names, trademarks, logos, generated product systems, algorithms, and other Cthru materials, except for Your Content and third-party content.

Subject to these Terms, Cthru grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the service for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the service except as allowed by these Terms or applicable law.

Copyright and rights complaints

If you believe content on Cthru infringes your copyright, trademark, publicity, privacy, or other rights, contact support@cthru.app with enough information for us to review the complaint, including the content at issue, the rights you believe are affected, and how we can contact you.

Cthru may remove or restrict content and may suspend or terminate accounts that repeatedly or seriously infringe third-party rights.

Subscriptions, trials, and paid features

Cthru currently does not charge users, collect subscription revenue, or offer paid features in the first beta. Cthru may offer subscriptions, free trials, or paid features in the future. Paid features would unlock Cthru-created functionality and service value; they would not sell or include Apple Music access.

If Cthru offers purchases inside the iOS app, payment and billing may be handled by Apple through in-app purchase. Apple may manage renewal, cancellation, billing, and refunds according to Apple's terms and policies.

Beta and TestFlight features

If you use a beta, TestFlight, preview, experimental, or unreleased version of Cthru, you understand that it may contain bugs, incomplete features, test data, limited availability, or changes that do not appear in the final public version. Beta features may be changed or removed at any time.

Availability and changes

Cthru may change, suspend, limit, or discontinue any part of the service at any time. Music availability, playback, recommendations, metadata, artwork, and provider features can change for reasons outside Cthru's control.

We do not guarantee that the service will always be available, uninterrupted, secure, error-free, accurate, or that any station, playlist, profile, recommendation, Tune In session, or playback session will meet your expectations.

Termination

You may stop using Cthru at any time. Cthru may suspend or terminate your access to the service if we believe you violated these Terms, created risk or legal exposure, infringed rights, abused the service, or if we discontinue the service.

After termination, sections that by their nature should survive will survive, including intellectual property, feedback, disclaimers, limitation of liability, dispute terms, and any payment obligations already incurred.

Disclaimers

The service is provided "as is" and "as available." To the fullest extent allowed by law, Cthru disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and error-free operation.

Cthru does not warrant that music playback, Apple Music access, recommendations, generated stations, generated playlists, Tastemaker surfaces, Tune In sessions, or user content will be available, accurate, uninterrupted, synchronized, or suitable for your needs.

Limitation of liability

To the fullest extent allowed by law, Cthru and its affiliates, employees, contractors, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, device failure, or unauthorized access, even if we have been advised of the possibility of those damages.

To the fullest extent allowed by law, Cthru's total liability for any claim relating to the service or these Terms will not exceed one hundred U.S. dollars.

Indemnity

To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless Cthru and its affiliates, employees, contractors, agents, and licensors from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your use or misuse of the service, Your Content, your violation of these Terms, your violation of law or third-party rights, or your violation of Apple Media Services Terms or other third-party terms. This section may not apply to the extent prohibited by consumer protection law.

Apple terms

If you downloaded Cthru from the Apple App Store, these Terms are between you and Cthru, not Apple. Cthru, not Apple, is responsible for the service and its content. Apple has no obligation to provide maintenance or support for Cthru.

To the extent Cthru fails to conform to any applicable warranty that has not been effectively disclaimed, you may notify Apple, and Apple may refund the purchase price, if any, for Cthru as required by Apple's terms. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for Cthru.

Apple is not responsible for claims relating to Cthru, including product liability claims, legal compliance claims, consumer protection claims, privacy claims, or intellectual property claims, except as required by applicable law. If a third party claims that Cthru or your possession or use of Cthru infringes that third party's intellectual property rights, Cthru, not Apple, is responsible for investigating, defending, settling, and discharging that claim.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries. You must comply with applicable third-party terms when using Cthru.

Governing law

These Terms and any dispute relating to them or the service are governed by the laws of the State of New York and the laws of the United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.

Changes to these Terms

Cthru may update these Terms from time to time. When we make changes, we will update the effective date above. If changes are material, we may provide additional notice or ask you to accept the updated Terms before continuing to use account-based, Apple Music-powered, cloud, sharing, Tune In, or paid features.

If you do not agree to updated Terms, stop using the affected features and, if applicable, delete your account.
